OPINION

FLEMING, J.

The Murder. At 9:30 on the night of 30 June 1974 in the yard of a house in Venice, California, Victoriano Munoz and Pedro Gomez were accosted by three Negroes attempting to rob them. As Gomez fled, he saw one of the three shoot Munoz with a short rifle, and he heard a bullet buzz by his ear. Neither then nor later could he identify any of the three robbers...
