This is an appeal from a conviction for assault with intent to murder. The alleged assault occurred on a newly born male child found on June 11, 1974, abandoned in a women's toilet at the Lodgepole State Wayside Park in Kimball County, Nebraska. The defendant was found guilty by a jury, and sentenced by the District Court to the State of Nebraska Department of Corrections for not less than 3 years and 6 months, nor more than 7 years.
