Judgment modified, on the law, by adding to the third decretal paragraph thereof, immediately after the words "dismissed on the merits", the following: "except the cause of action which seeks reasonable attorneys' fees and, as to said cause of action, a hearing shall be held to determine the amount of the fee which shall be paid by Garlick Funeral Homes, Inc.". As so modified, judgment affirmed, without costs or disbursements. The findings of fact are affirmed.
