On March 16, 1974, the plaintiff, Charles DeGrove, was riding in his automobile. The automobile was being driven by the defendant, Mark Noble Sanborn. An accident occurred and the plaintiff was injured. The plaintiff filed a complaint in the circuit court for the County of Macomb. On December 16, 1975, the Honorable George R.
