On July 29, 1972 the complainant answered the doorbell ring at his home in Queens and admitted two men, one of whom (the appellant herein) flashed a badge and identified himself as a detective from the homicide squad. Once inside, appellant drew a gun and said "I am no cop. I am taking you off."
