This cause is before us on a writ of certiorari directed to the New Mexico Court of Appeals in State v. Smith (filed May 18, 1976), 89 N.M. 777, 558 P.2d 46 (Ct. App. 1976), which affirmed a conviction of defendant for the crime of voluntary manslaughter.
