This is an appeal from a judgment dismissing a portion of plaintiff's claims for workmen's compensation benefits. An answer to the appeal has been filed by the defendant in connection with the assessment of statutory penalties and attorney's fees. We reverse with respect to the granting of penalties and attorney's fees.
