TYSON, Judge.

The appellant was indicted for the first degree murder of Otis Lee Robinson, "by shooting him with a pistol." Following a jury trial the appellant was found guilty of murder in the first degree, and his punishment fixed at life imprisonment. The trial court then entered a judgment in accordance with this verdict.

The appellant's motion for new trial was overruled following a hearing thereon.
