Defendant Richard Emery appeals from a finding of guilt on a charge of burglary, and from the consequent sentence of not less than 4 nor more than 12 years (which followed a guilty plea by Emery). Emery was indicted on the burglary charge and for theft under $150. The plea of guilty was entered to the burglary count, and thereafter on motion of the State the count charging theft...
