The appellant sued the appellee city for damages resulting from an alleged nuisance maintained by the appellee. The trial court dismissed the appellant's complaint for failure to state a claim upon which relief can be granted. The judge held that the acts allegedly done by the appellee to the appellant as a matter of law did not constitute a nuisance, but instead were tortious in nature.
