Following a jury trial in August 1971, defendant, Michael Alexander, was convicted of rape and burglary with intent to commit rape. He received concurrent penitentiary sentences of 10 to 15 years for each offense. The judgments were affirmed on direct appeal by this court on May 3, 1973 (People v. Alexander,
