JOSLIN, Justice.

On May 23, 1974 the defendant Gerard J. Salvail, after pleading nolo contendere in the Superior Court to an indictment charging him with breaking and entering, was sentenced to a 5-year term, but the execution thereof was suspended and he was placed on probation; on January 3, 1975 the defendant, Thomas H. Austin, having previously been indicted for statutory burning, entered into a deferred sentence agreement with the Attorney General...
