In a two count indictment, appellant, Lester Perry, was charged with the crimes of kidnapping and assault and battery with intent to kill. On January 19, 1971, a jury returned a verdict of guilty of kidnapping, Ind. Code § 35-1-55-1, and of the lesser included offense of assault and battery, Ind. Code § 35-1-54-4. By judgment duly entered, appellant received a sentence of life imprisonment for kidnapping and a fine of one thousand dollars...
