The two appeals decided by this opinion arise from the same lawsuit and therefore have been consolidated for purposes of decision.

Plaintiff commenced this lawsuit in November 1972 against attorneys Fallon Kelly, Hyam Segell, and William S. Fallon, claiming that they had negligently represented him during divorce proceedings in 1965, 1966, and 1967. In October 1974, after discovery was completed, defendants Segell and Fallon moved for summary judgment...
