MEMORANDUM AND ORDER

FRANK A. KAUFMAN, District Judge.

Plaintiff, Carmine Colander, pursuant to 42 U.S.C. § 405(g) incorporated by reference through 30 U.S.C. § 923(b), asks this Court to reverse a final decision of the Secretary of Health, Education and Welfare (the Secretary) denying his claim for "black lung" benefits under the Federal Coal Mines Health and Safety Act as amended, 30 U.S.C. §§ 901 et seq. (the Act).
