On October 31, 1972 plaintiff, Mrs. Virginia West Karmgard, was advanced the sum of $35,000 by defendant, Southland Mortgage and Title Company. Pursuant to this advance plaintiff executed a promissory note to defendant's order in the amount of $41,300 with interest from maturity until paid at the rate of 8% per annum payable in 12 consecutive monthly installments.
