On March 2, 1973, Ralph L. Newell slipped and fell on a toy Volkswagen somehow present in an aisle at Millers Department Store in Jackson. He sued for damages in the Circuit Court of the First Judicial District of Hinds County, Mississippi, and obtained a jury verdict in the amount of $50,000. On appeal, Millers cites several errors.
