DONOFRIO, Presiding Judge.

After a trial by jury, appellant was convicted of (1) assault with a deadly weapon, (2) aggravated battery and, (3) possession of a pistol by a criminal. Appellant was sentenced to not less than three nor more than five years in the Arizona State Prison on each count, the sentences to run concurrently.
