Defendant, John Gilbert Harbarugh, was charged in a two-count indictment with theft in violation of section 16-1 of the Criminal Code of 1961 (Ill. Rev. Stat. 1971, ch. 38, par. 16-1). Specifically, the first count charged him with stealing from Linda Tuman a stereo set exceeding $150 in value.
