The primary issue raised on this appeal is whether the trial court erred in its decision, dated October 5, 1973, denying defendant's motion to suppress certain evidence. At approximately 1:30 A.M. on June 9, 1973, Trooper Micilcavage observed a 1966 Volkswagen suburban van parked on a side street in the Town of Chenango.
