Defendants, Walter August Jablonski and Richard E. Aleman, were charged with the possession of burglar's tools, MCLA 750.116; MSA 28.311, and attempted breaking and entering of an occupied dwelling with intent to commit larceny, MCLA 750.92; MSA 28.287 and MCLA 750.110; MSA 28.305. Defendants were jointly bench tried in Wayne County Circuit Court. At the close of the prosecutor's proofs, the trial judge granted defendants' motion to dismiss the possession...
