OPINION

FRANSON, J.

Appellant was indicted on September 3, 1974, for the murder of his wife, Mary Jo, on or about October 18, 1972. He was arraigned and pleaded not guilty. Jury trial commenced November 10, 1974, and on December 12, 1974, the jury found appellant guilty of murder in the first degree. He was denied probation and sentenced to the term prescribed by law.
