SCOTT, Justice.

This is an appeal from an order granting a new trial in an action to recover on a fire insurance policy. Defendant insurer refused to pay, claiming the fire was caused by an intentional act of plaintiff. The matter was tried in Washington County District Court. The jury returned a verdict in favor of defendant insurer. The court granted plaintiff's motion for a new trial. Defendant petitioned this court for discretionary review, which was granted....
