Plaintiffs seek damages under the state tort claims act, RCW 4.92.090,1 for the deaths of their daughters. Their actions have been consolidated for the purpose of this appeal. Both young women were allegedly murdered by James Ruzicka, an escapee from the sexual psychopath program at Western State Hospital. The State's defense is that the crime victims compensation act, RCW 7.68, provides the exclusive remedy for the damages...
