Plaintiff initiated this action in circuit court for rescission of a release executed by him in favor of the defendant. A trial was held before the court sitting without a jury on stipulated facts which resulted, on July 11, 1975, in a judgment for the defendant. The plaintiff appeals as of right.

The operative facts were set out by the trial court in his opinion:
