The defendant, Augustine Olivas, was charged by indictment with possession of a controlled substance (heroin) in violation of section 402(a) of the Controlled Substances Act. (Ill. Rev. Stat. 1973, ch. 56 1/2, par. 1402(a).) Subsequent to a jury trial, he was found guilty of the offense charged and sentenced to the Department of Corrections for a term of not less than 5 years nor more...
