ELLETT, Justice:

The defendant appeals from a conviction of the included offense of attempted robbery by the use of a deadly weapon (a firearm).

The facts regarding the occurrence of the robbery are not in much dispute. Claude Parks, a four-time convicted felon, was released from Leavenworth Penitentiary and boarded a bus headed for the state of Washington via Salt Lake City, Utah.
