BOISE CASCADE CORPORATION, Petitioner, v. EMPLOYMENT DIVISION, Ross Morgan, Administrator, Respondent.

Court of Appeals of Oregon.

Decided June 28, 1976.

Attorney(s) appearing for the Case

Harry S. Chandler, Portland, argued the cause and filed the brief for petitioner.

John W. Burgess, Asst. Atty. Gen., Salem, argued the cause for respondent. With him on the brief were Lee Johnson, Atty. Gen., and W. Michael Gillette, Sol. Gen., Salem.

Before SCHWAB, C.J., and LANGTRY and FORT, JJ.

PER CURIAM.

Reversed.

PER CURIAM.

The respondent concedes that in order for it to prevail, we must overrule Employment Div. v. Edw. Hines Lbr., 19 Or.App. 866, 529 P.2d 934 (1974), Sup.Ct. review denied (1975). We find no reason for so doing.
