MEMORANDUM OPINION AND ORDER

EUBANKS, District Judge.

33 U.S.C. § 1321(b) provides, in pertinent part:

"The discharge of oil or hazardous substances into or upon the navigable waters of the United States ... is prohibited .... * * * * * * "Any owner or operator of any vessel, onshore facility, or offshore facility from which oil or a hazardous substance is discharged ... shall be assessed a civil penalty ... of not more...
