Phillip Richards was charged in the Mayes County District Court, Case No. CRF-76-49, with the offense of Unlawful Delivery of a Controlled Dangerous Substance — Heroin, in violation of 63 O.S. Supp. 1975, § 2-401 ¶ A-1.
