This is an appeal by the government from the district court's dismissal of a petition to enforce an Internal Revenue Service summons. The principal issue on appeal is whether the district court erred in ordering an IRS special agent to answer, in the course of his deposition, specific questions about a criminal investigation of the taxpayer.
