The issue presented is the validity of the arrest of the defendant on a charge of operating a motor vehicle while under the influence of intoxicating liquor. RSA 262-A:62 (Supp. 1975). At the conclusion of the state's case, the defendant moved for dismissal on the basis that there was no proper arrest made.
