The above-captioned case was originally assigned to the late Chief Judge Sheridan and a mistrial therein was declared by him on February 9, 1976, when the jury was unable to reach a verdict. Following Judge Sheridan's death on August 23, 1976, the case was reassigned to the undersigned judge on October 1, 1976.
