This is an appeal from a Summary Final Judgment of the Circuit Court of Palm Beach County.

Briefly stated, the undisputed facts are as follows: Resnick Developers South, Inc., as owner, contracted with William Passalacqua Builders, Inc., as general contractor, for the construction of a condominium.
