By an indictment returned on April 22, 1975, the defendant, Michael Joseph Orzechowski, was charged in two counts with violation of 21 U.S.C. § 841.1 Count I charges that on March 24, 1975, the defendant unlawfully possessed with intent to distribute, and did distribute 13.602 grams of cocaine, a Schedule II Narcotic Drug Controlled Substance.
