Appellant, Archie Burl Doty, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County, Case No. CRF-74-4143, for the offense of Possession of Marihuana With Intent to Distribute, After Former Conviction of a Felony, in violation of 63 O.S. 1971, § 2-401, ¶ B 2.
