Clark J. Guild, Jr. (Guild), as executor of the estate of Elmer West (West), deceased, brought this action against Mary B. Adrian (Adrian) and First National Bank of Nevada (Bank) to recover the sum of $54,000 taken from West's bank account a few days prior to his death, by Adrian, acting through a power of attorney.
