In an action to collect death benefits under a life insurance policy, the defendant moved to dismiss the plaintiff's complaint and the plaintiff cross-applied for summary judgment.1 The Special Term denied both motions and the plaintiff appeals the denial of her cross application. We reverse and grant summary judgment to the plaintiff.
