This is a suit on a promissory note instituted by East Texas Teachers Credit Union against John L. Wall. The note called for usurious interest on its face and there have been no payments of principal or interest. The judgment of the trial court for the Credit Union was modified by the Court of Civil Appeals "to provide that" the Credit Union "do have and recover of and from the appellant John L. Wall the sum of $20,803.48,
