This case is before us on a petition by the state for review of the decision of the Court of Appeals. State v. Stalheim, 23 Or.App. 371, 542 P.2d 913 (1975). Defendant was convicted of criminally negligent homicide after the car he was driving struck an oncoming vehicle and killed two people.
