OPINION

JAMES, Justice.

This is a suit by the buyer against the seller for breach of an oral contract to sell and deliver used bricks. Trial was had to a jury, which rendered a verdict favorable to the Plaintiff buyer, pursuant to which verdict the trial court entered judgment. We affirm in part and reverse and render in part.
