Plaintiff sued defendant to recover money it paid out to repair and replace an air conditioning unit located on premises plaintiff leased from defendant. After a trial before the court, judgment was entered in plaintiff's favor. Defendant filed a motion for a new trial which was denied. Defendant appeals as of right.

Plaintiff leased the building for use as a restaurant. The lease provided in part as follows:

"The Landlord will be responsible...
