Appellants, Tommy Nolen Batie and Joe Allen Batie, hereinafter referred to as defendants, were charged, tried and convicted in the District Court, Cimarron County, Case No. CRF-74-49, for the offense of Attempted Robbery With a Dangerous Weapon, in violation of 21 O.S. 1971, § 801.
