On June 19, 1975 the federal grand jury for the Northern District of Iowa returned a two-count indictment charging appellant, Elizabeth Gail Ashford, with two violations of the postal laws of the United States.

The first count charged that on or about June 22, 1974 at Cedar Rapids, Iowa the defendant in violation of 18 U.S.C. § 1702 did unlawfully take a letter which had been in a post office and authorized depository for mail matter...
