Mrs. Ballard was indicted for the offense of child abuse pursuant to the provisions of Title 14, Section 41(1), Code of Alabama.

Omitting the formal parts the indictment reads as follows:

"The GRAND JURY of said County charge, that, before the finding of this indictment KAREN KAY BALLARD whose name is to the Grand Jury otherwise unknown than as stated, and who is over the age of eighteen years...
