GUNN, Judge.

Defendant was convicted for illegal possession of heroin. The only issue on appeal is whether the trial leading to his conviction placed defendant twice in jeopardy in violation of his constitutional guarantees. We find defendant's right against double jeopardy was not violated, and we affirm the judgment.
