Robert Lynn Massengale, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Grady County, Case No. CRF-74-69, for the offense of Unlawful Possession of Marihuana With Intent to Distribute, in violation of 63 O.S. 1971 § 2-401 and was sentenced to two (2) years' imprisonment.
