Jimmy Goodner, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Bryan County, Case No. CRF-74-98, with the crime of Unlawful Possession of Marijuana with Intent to Distribute, in violation of 63 O.S. 1971, § 2-401 ¶ B 2.
