DENECKE, Justice.

The trial court sustained defendant's demurrer to plaintiff's complaint seeking damages for personal injuries. The court ruled that the statute of limitations had run. Plaintiff appeals contending that defendant voluntarily appeared before the statute ran, that defendant is estopped to raise the statute, and that defendant waived his right to raise the statute of limitations.
