The defendant moves this court to dismiss this cause on the following grounds, to wit:

1. Because the complaint fails to state a claim upon which relief can be granted. 2. The court lacks jurisdiction because the amount actually in controversy is less than $10,000.00 exclusive of interest and cost. 3. The court lacks jurisdiction upon any other basis.
